Total Repair Coverage Terms and Conditions Each Total Repair Coverage (TRC) service “PLAN”, or in combinations “PLAN(S)” covers the cost of repairs to selected equipment as described in this Agreement. Responsibility For Benefits Owed To You AMT Warranty Corp. is the service contract issuer and provider responsible for the performance of contractual obligations under this Service Agreement, including service performance and payment of cost of any benefits owable to You under the Agreement. Home Service has designed the protection program provided to You under this Service Agreement, and manages and administers the delivery of benefits owed to You under the Agreement. Home Service will be responsible for reviewing, processing and adjusting any claim You may have for benefits under this Service Agreement. Home Service will serve as Your ordinary point-of-contact for any questions or concerns You may have with respect to Your Service Agreement; You may also contact the obligor and contract issuer, AMT Warranty Corp., with any further inquiries. AMT Warranty Corp. has given Home Service authority to act on its behalf in processing claims under this Service Agreement and in assisting You in processing payments and other transactions under this Agreement, and Home Service will act on behalf of AMT Warranty Corp. in providing these services to You. Obligations under this Service Agreement are underwritten and supported by contractual liability insurance procured by the obligor, as detailed in the applicable state disclosures attached to this Agreement. All other terms and conditions of this Service Agreement are subject to, and modified by, the allocation of responsibilities set forth in this paragraph, unless otherwise indicated for residents of Your state as detailed in the applicable state disclosures attached to this Agreement. PLAN(S) cover(s) residential systems in single family households for Covered Repairs due to normal wear and tear including inherent defects in the materials and are available to the owners of the property or their authorized representatives (“Customer”). Multi-unit housing including but not limited to condominiums, duplexes and apartment houses, and any facility used for commercial purposes are not eligible. The Administrator reserves the right to change the fee or to modify the program upon giving you thirty (30) days’ written notice. If there is more than one system in the residence, a separate PLAN(S) must be purchased for each piece of equipment, or no PLAN(S) will be considered sold or serviced. Customer benefits include the ability to have a contractor assigned and dispatched when a service call appears to be required. The Administrator will dispatch a pre-qualified contractor to repair covered components. We pledge to expedite the dispatch and service call process however effective response times may be affected by extreme weather conditions and time-of-year situations. All calls for repairs will be handled in the order in which they are received (except emergency calls – see below). The Administrator will handle Customer calls for service 24/7. Service requests after 5pm will be assigned and dispatched the following day, except emergency calls which will be handled immediately. Emergency calls being defined as no-heat calls (from HEAT Plan Customers) during the winter heating season, defined as Nov 1st – March 31st. Except in the case of emergency situations, overtime, premium or holiday rates are not covered. The Administrator will pay for the cost of labor and parts covered by PLAN(S), up to $1500 annually for each HEAT, COOL or PUMP PLAN(S). Parts may be replaced with an equivalent make, type or style. The Administrator provides no express or implied warranties for existing equipment or condition and the Customer is responsible for the cost of repairs that are not covered by a PLAN(S). Preventive maintenance is not covered under any PLAN(S). The Administrator and its approved contractors shall not be responsible for service or parts the Customer has others provide. Coverage of each PLAN(S) starts after the first payment is received and continues thereafter so long as the Customer makes timely payments. Customer payments prepay coverage under the PLAN(S). Coverage is suspended at the end of the prepaid period in cases of nonpayment. Customer account must be in good standing to receive repair service under this program. For each PLAN(S), the Agreement is automatically renewed upon receipt of payment from Customer for a new TERM. A TERM is defined as 12 (twelve) months in length and the initial Term commences on the Enrollment Date. Failure to pay for a new TERM upon the expiration of an existing TERM will result in lapse of coverage. Customers may cancel the agreement with no obligation within 30 days of enrollment and obtain a full refund of any fees paid. All covered equipment must be installed to manufacturers’ specifications and meet code requirements. The Administrator reserves the right to inspect equipment any time after the receipt of an enrollment, and to reject the application if the equipment to be covered is not functioning properly. To be eligible for the program, all equipment must be installed to meet local, state and federal codes, must satisfy manufacturer requirements for proper installation, must be in good operating condition at the time of enrollment and must be properly maintained. The Administrator reserves the right to withhold service and cancel PLAN(S) for any equipment that is found to be out of compliance with these eligibility requirements. The Customer is responsible for preventive maintenance such as routine cleaning, replacement of air filters and air registers, chimney cleaning, lubrication of motors, and refrigerant recharge (except on covered repairs) in accordance with manufacturers’ recommendations. The Customer is also required to provide the Administrator and its contractors with safe and reasonable access to the premises and appliances. In addition, PLAN(S) does not cover the cost of gaining access to system components or restoration costs such as plaster, drywall, or ceiling repair. The Customer is responsible for standard service fees by the dispatched contractor unless covered work has been performed, in which case service charges are waived. Charges for service calls where no covered work has been conducted, or for routine maintenance or diagnostic work requested by the Customer, are subject to standard service fees by the dispatched contractor. PLAN(S) do not cover any materials, parts or labor required as a result of flooding, fire, freezing, riots, any abnormal conditions, Customer negligence or the replacement, repair or maintenance of any devices, parts or controls other than those specifically covered by each PLAN(S). PLAN(S) also does not cover service involving hazardous or toxic material, including asbestos, disposal of contaminants (e.g. refrigerants), upgrade required by federal, State or local law, failure due to rusts, rot or corrosion, missing parts or components, and failure caused by negligence or acts of God. Furthermore, the Administrator will not be liable for damages incurred by the Customer or anyone else, caused by unavoidable delays, failure to service, obsolete parts, unavailability of parts, equipment failure, weather conditions, work stoppage, strike and other circumstances beyond our control. If any provision of the PLAN(S) shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from the remaining provisions, which shall remain in full force and effect. The waiver or failure of the Administrator to exercise any right in connection with the PLAN(S) shall not be deemed a waiver of any further right thereof. This program is intended for the repair of covered equipment, not the replacement of equipment which we deem beyond repair. If PLAN(S) determines that a piece of covered equipment cannot be repaired, PLAN(S) reserves the right not to repair the equipment but to recommend the equipment be replaced at owner’s expense. In the event that PLAN(S) does not make a repair for this reason, the service call will be covered by PLAN(S). Heating System Repair Plan (HEAT) Covered Repairs Most major parts of a central natural gas, forced-air or circulating hot water, heating system, including: air scoops, aquastat, barometric damper, belts and pulleys, blower motors and blower wheels, circuit boards, circulator motor/coupler (not circulator), ECO safeties, fan and limit controls, fusible links, gas valves, ignition controls, induced draft motor, blower, low water cutoff, main and pilot burners, pilots and thermocouples, pressure switch, regulator valves, relays, spill switches and transformers. Non-Covered Repairs Air ducts, air filters, air zoning electronics and components, electronic air cleaners, air temperature control, asbestos coverings, A.C. coils and controls, balancing of system, belt drive blowers, chimney maintenance or repairs, thermostat, air conditioners, dual-fuel burners, electric house wiring, fan coils and other auxiliary heating, flue restrictors, gas piping, heat exchangers, heating jacket, trim insulations, humidifiers, leaking boiler sections, line circuit breakers, radiator relief and vent valves, radiators, registers, seasonal turn-ons/offs or pilot relights, tankless water heaters, vent dampers, vent pipe, water and steam piping, water coils and steam coils, and any parts not explicitly stated in this Agreement as covered. Exclusions include, furnace or boiler rated at inputs of 400,000 BTU/hr or more; rooftop, through the wall, hanging units, space heaters, heat pumps, geothermal heat pumps; combination ambient heat/domestic hot water heating units; oil or propane heating systems. Cooling System Repair Plan (COOL) and Heat Pump Repair Plan (PUMP) Covered Repairs Cooling System: Most major parts of electric central air conditioning systems including: capacitor, circuit boards and Internal fuses, condensate pumps, condenser motor/fan, contactor switches, delay timer, fan controls and relays, filter drier, high and low pressure switches, limit controls, refrigerant (excluding maintenance recharges)*, relays, transformers, valves, * = R22 Refrigerant – limited to once per season. First pound is free, additional R22 will be added, if needed, for a fee based upon rate in effect at that time. Heat Pumps: Most major parts of electric central Heat Pump systems including: All COOL components and defrost controls, defrost sensors. Non-Covered Repairs Air ducts, air filters, asbestos coverings, balancing of system, cleaning of condenser or evaporator coils or components, compressors or chillers, condenser casings, condenser coils, evaporator coils, electric house wiring, electronic air cleaners, humidifiers, line circuit breakers, metering systems/TXV valves, registers and grills, thermostat, and any parts not explicitly stated in this Agreement as covered. Exclusions include, systems exceeding five tons capacity or Improperly sized units; systems that use other than R-22; gas cooling systems (including ammonia); rooftop, window, through the wall, hanging units, geothermal heat pumps or combination ambient heat/domestic hot water heating units. Water Heater Repair Plan (WH) Covered Repairs Most major parts of tank-based electric, natural gas and propane water heaters, including: Gas Water Heater: Burner supply tube and assembly, drain valve, gas valve, pilot light, supply tube and assembly, temperature control, thermocouple, T/P relief valve, main burner. Electric Water Heater: Drain valve, lower thermostat, lower element, T/P relief valve, upper thermostat, upper element. In the event that the estimated cost of a Covered Repair - including diagnosis - will exceed $500 or we otherwise deem it unfeasible to carry out a Covered Repair, We will offer You the following options: - We will carry out the Covered Repair to a maximum value of $500 and you will be liable to the Technician for any amount in excess of this amount, or; - We will not carry out a Covered Repair, but instead We will reimburse You up to $500 towards the cost of purchasing a new Water Heater upon production by You of a valid receipt. Non-Covered Repairs The PLAN(S) also does not cover the anode rod, exhaust venting, jacket and interior doors, supply and delivery water piping, wiring and or electric service, and any parts not explicitly stated in this Agreement as covered. Exclusions include commercial grade water heaters and tanks larger than 100 gallons; tankless systems; rooftop, or hanging units, or combination ambient heat/domestic hot water heating units. In the event that We or Our Technician make You aware of any reasonable remedial or maintenance work required to Your Water Heater to prevent a Covered Repair, You must provide evidence of having carried out such work in order for Your coverage to continue. We will not carry out Covered Repairs where We have made You aware of the need for such maintenance or remedial work and You have failed to undertake it. Definitions: The PLAN(S) for which You have coverage are listed on the Coverage Summary Page. Please note You may not have coverage under all parts of this contract if You have not opted for the coverage. Customer, You or Your means the homeowner of a single-family residence and the purchaser of this Plan. We, Us, Our, Home Service and Administrator means (i) Home Service USA Repair Management Corporation, 1506 Klondike Road, Suite 105, Conyers, Georgia 30094 (“Home Service”), in its capacity as Administrator and manager of the benefits owed under this Service Agreement, and (ii) AMT Warranty Corporation, 59 Maiden Lane, New York, NY 10038 (“AMT Warranty Corp.”), which underwrites and is responsible for providing the benefits owed to You under this Service Agreement. You may contact us at the foregoing addresses or by calling us toll-free at 1-888-666-8075. Covered Repair(s) means any repair or replacement of eligible parts or materials as defined in these Terms and Conditions and not specifically excluded by these Terms and Conditions as defined under the section titled “Non-Covered Repairs.” Enrollment Date means the date Your payment was received by Us. Effective Date means the date You become eligible for Covered Repairs. Your Effective Date is thirty(30)days after Your Enrollment Date. Term means the period of time, starting with the Enrollment Date, Your PLAN(S) will remain in effect, assuming You have not had a Lapse of Coverage. This PLANS(S) can be automatically renewed by You provided We continue to offer the PLAN(S) and timely payments are made by You for additional Terms. If additional Terms are purchased by You without Lapse of Coverage, Your Effective Date of coverage will remain the same. If Your PLAN(S) lapses as outlined under Lapse of Coverage, You may re-enroll in the Plan with a new Plan Effective Date. This Plan may be cancelled as outlined under Cancellation. Lapse of Coverage. If full payment for the renewal of this Plan for an additional Term is not received by Us from You within thirty (30) days from the date payment was due, a Lapse of Coverage will have occurred. In such event, Your coverage under this Plan will terminate on the final day of the last Term for which You made full payment to Us in a timely manner, without notice to You. Our administration of this Lapse of Coverage provision in any one instance shall not be deemed to constitute a waiver of Our right to terminate Your coverage in the future as described under this provision. If Your payment is received by Us after a Lapse of Coverage has taken effect, Your payment will be returned to You. You must then re-enroll in the Plan. When Your coverage is re-issued, You will have a new Effective Date. Any additional billing resulting from the handling of a partial payment or Lapse of Coverage may result in a service fee. Cancellation. You may cancel this PLAN(S) any time by mailing a request for cancellation to Home Service: 5301 Blue Lagoon Drive Miami, FL 33126, or by calling the toll-free number (1-888-658-3800). If You cancel Your PLAN(S), any refund, if applicable, will be determined on a pro-rata basis less the cost of any service performed under the PLAN(S). You have thirty (30) days from Your Enrollment Date to cancel and receive a full refund of any payments made. Coverage will terminate for non-payment, without notice, thirty (30) days from the date payment was due. We have the right to cancel this program at any time upon ninety (90) days’ notice. Technician. We agree to perform the services hereunder and may contract with an independent technician to fulfill repair or replacement services, this entity will be known as a Technician. In no event shall Our Technicians, or any of Our Technicians’ agents or employees, be deemed agents and employees of Ours. Agreement. This Agreement is the complete and exclusive statement of the understanding of the Parties with respect to the PLAN(S) and supersedes all prior understandings and agreements, whether written or oral, between Home Service and You relating to the subject matter hereof. Terms and Conditions. The Terms and Conditions are included in, and are a subset of, the entire Agreement. Non-covered Repairs are any and all repairs (materials and associated labor charges) that occur on parts or materials not explicitly stated as a Covered Repair under the PLAN(S). Party or Parties shall mean either Home Service or You, the person that has entered into this Agreement (together referred to as the “Parties”). Eligibility for Coverage: You must own the single-family detached residence within which or to which the Covered Service(s) is attached. Your Covered Service(s) must be in working order and free of leaks, blocks, breaks damage or existing malfunction prior to enrolling in this program. Multi-family homes, including but not limited to condominiums, duplexes and apartment houses, and any facility used for commercial purposes are not eligible for coverage under this Agreement. Administrators Rights: We reserve the right to change the fee for the PLAN(S) upon giving You thirty (30) days’ written notice. We also reserve the right to modify this program upon thirty (30) days’ written notice to You. Our obligations are limited in the event Your property was not eligible for coverage under the PLAN(S). If the Administrator determines Your property was not eligible, then Our sole obligation under the PLAN(S) is to refund the payments made by You. When this refund is paid, the PLAN(S) will be void as of the date of the original Enrollment Date. YOUR PLAN(S) IS NOT AN INSURANCE CONTRACT, AND IS NOT TRANSFERABLE. YOUR PLAN(S) PROVIDES REPAIR OR REPLACEMENT SERVICE FOR COVERED REPAIRS REQUIRED DUE TO NORMAL WEAR AND TEAR INCLUDING INHERENT DEFECTS IN MATERIAL. WE SHALL NOT BE LIABLE FOR DAMAGES, INCLUDING ANY INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, THAT ARISE FROM (1) ANY DEFECTS IN MATERIALS USED TO MAINTAIN COVERED REPAIRS; OR (2) DEFECTS IN WORKMANSHIP PROVIDED UNDER YOUR PLAN(S). THERE ARE NO EXPRESS OR IMPLIED WARRANTIES, WARRANTIES OF MERCHANTABILITY, OR WARRANTIES OF FITNESS FOR A SPECIFIC PURPOSE OFFERED WITH YOUR PLAN(S). OUR LIABILITY FOR DEFECTIVE MATERIALS OR WORKMANSHIP IS LIMITED TO REPAIR OR REPLACEMENT OF THE DEFECTIVE MATERIAL AND/OR A CORRECTIVE SERVICE VISIT. WE SHALL NOT BE LIABLE UNDER ANY CIRCUMSTANCES FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOST PROFITS OR ANY OTHER EXPENSES, LOSS OR DAMAGE DIRECTLY OR INDIRECTLY ARISING FROM THE PERFORMANCE OR NONPERFORMANCE OF YOUR PLAN(S) OR ANY COVERED SERVICE(S) UNDER YOUR PLAN(S) OR THE USE OR INABILITY TO USE THE COVERED SERVICE(S) TO WHICH YOUR PLAN(S) APPLIES.
